General terms & conditions of use of the site www.iota-group.com

 

Preamble:

The purpose of the website located at www.iota-group.com (the “Site”) is to present to the public the activities of the IOTA Group and its subsidiaries, the range of services offered and to promote them. This Site also aims at providing users with job opportunities by replying to job offers or submit spontaneous job application. Any user is invited to read the present general terms & conditions (the “Terms of Use”) carefully, considering that access and/or use of the Site is regarded as an express acceptance of the Term of Use.

 

ARTICLE 1: Object

The Terms of Use define the terms and conditions of use & consultation of the Site, its contents, its related services and the authorized use by the User.

The Terms of Use must be accepted by any User who access the Site. The access and/or the use of the Site implies unreserved acceptance of the present Terms of Use.

The IOTA SA, owner of the website, reserves the right to change unilaterally without notice the present Terms of Use.

 

ARTICLE 2: Legal notice

Publication of the Site is provided by IOTA S.A which head office is located at 26 route de la Gare, 1295 Mies, Switzerland.

The Head of the publication is Mr Thierry CUSIN.

The Site is hosted by ACESI SARL, a company incorporated in Switzerland having its head office at Route des Jeunes 9, 1227 Geneva.

 

ARTICLE 3: Definitions

  • User: refers to anyone who accesses or uses the Site or any of its services.
  • User content: means any data transmitted by the User to the Site.
  • Member: a User becomes a member when identified on the Site.
  • Personal ID and password: refers to all information required to identify a User/Member. Personal ID and password give access to services for Member. The password is confidential.

 

ARTICLE 4: Access to services

The Site offers the User a free access to the following services:

  • information articles about IOTA Group,
  • links to commercial operations,
  • job opportunities,
  • a dedicated space for spontaneous job application.

Access to the Site and its services are free. However, the User bears all other access costs (hardware equipment, software, Internet connection, etc.).

The Site makes its best efforts to ensure a high quality access to it or its services but cannot guarantee to reach such result. The Site cannot be held responsible should a force majeure event occurs such as a disturbance /malfunction of the network or of the servers. Access to the Site or to its services might, at any moment, be subject to unlimited interruption, suspension, modification without notice resulting from maintenance operation or any other cause. The User agree not to be entitled to claim compensation as a result of interruption, suspension or modification of the Site or the proposed services.

ARTICLE 5: Intellectual Property

All trademarks, logos, signs and other content of the Site are protected by law and international conventions on intellectual property and more specifically by copyright.

The User must imperatively request prior written authorization of IOTA SA for any reproduction, publication, copy (even partial) of any of the foregoing listed objects of intellectual property.

 

Article 6: Limitations of use of the Site and Services

The User agrees to use the Site and its services for private needs only. Use for commercial purposes is strictly prohibited.

Any content posted by the User is on his sole responsibility. The User agrees not to put on line any content that may have a negative impact on the interests of IOTA Group and/or third parties, such as inappropriate content or likely to offend public order or morality.

The User agrees to indemnify and hold harmless IOTA Group against any action or legal action lead against IOTA Group as a result of a content posted by the User.

Any content posted by the User, particularly if inappropriate, may be at any time and for any reason deleted or modified without notice.

 

ARTICLE 7: Personal Data

 

7.1 Personal data

The User is informed that the e-mail address he has communicated during the registration process will be stored and used by the Site for administration, management and animation of services purposes.

For accessing the Site and/or using the services, the User may be required to communicate personal or sensitive information, in particular the following:

  • name and surname,
  • address and email address,
  • civil status,
  • previous position held and professional experiences (including a resume), education details, current position,
  • age, date and place of birth.

Foregoing information are collected through different online forms.

“Cookies” may also be collected. Cookies collection can be switch off and/or deleted at any time by the User, however it could limit or prevent access to the Site or services.

 

7.2 Purpose of collection

Collected information might be used for administration and management of the Site and of the services, and in particular:

  • audience tracking and communication purposes,
  • Newsletters,
  • email campaigns,
  • reply to User’s request for information,
  • management and assessment of User’s application to a job offer/opportunities,
  • disclosure to any third party who is part of the recruitment/assessment process,
  • should the User be recruited, employment management and international mobility.

The Site strictly respects, and guarantees that its IT providers do as well, confidentiality of the personal information collected and to use it only for the foregoing purposes mentioned.

Personal information may be communicated to legitimate authorities based on a formal order.

The Site guarantees that collection and processing of User’s personal information is carried out in strict compliance with the legal provisions enforceable regarding collection and storage of personal data.

 

7.3 Security

Personal information are stored in a secure environment. To ensure safety and integrity to User’s personal information, the Site is using the following means:

  • SSL Protocol (Secure Sockets Layer),
  • Network monitoring tool,
  • Backup,
  • Digital certificates,

The Site makes its best efforts to ensure a high level of security by implementing, in addition to the foregoing listed security means, a strict organization measures and the latest technologies. However, as no system is secure, the User is aware that risks of loss or unauthorized use of his personal information still exists and accept such risks. From his end, the User agree to take all possible measures to protect his own personal information and in particular to keep his personal ID and password secrets. Any disclosure of his password and/or personal ID is not authorized.

 

7.4 User’s right to access, change, deletion and opposition to use of his information

The User has the right, at any time, to access, rectify, delete and oppose the use of his personal data. The User exercises his right via:

  • his personal space;
  • a contact form;
  • by email to [email protected];
  • by post mail to IOTA Group at Route de la Gare, 26 – 1295 Mies, Switzerland.

 

ARTICLE 8: Liability and force majeure

All information published on the Site are from reliable source and have been carefully controlled and selected by IOTA Group. However, no guarantee can be made and IOTA Group may not be held responsible in this respect.

The information disclosed on the Site are general and for informational purposes only. The information is not and cannot be regarded as a contractual terms binding IOTA Group. Thus, the User is sole liable of the use of the information and any content, when expressly authorized, of the Site that he may have.

The User must take all measure to keep his personal ID and password strictly secret and agree not to disclose it to anyone. Any disclosure of password is prohibited and the Site will not be responsible thereof.

Unauthorized or improper use of the Site and/or Services that causes direct or indirect damages will lead to civil claim.

Notwithstanding the foregoing, the Site reserves the right to ban a User, who has breach the present Terms of Use, to access the Site and / or Services and to exclude any member.

 

IOTA Group certifies to implement and maintain the highest level of security and confidentiality of User’s personal information in accordance with the IT standards and the state of the art.

However, no absolute guarantee may be granted about security and confidentiality of personal information communicated by the User. The User certifies to be informed and aware of such circumstances and accepts, knowingly, to bear risks related to security and confidentiality failures out of IOTA Group’s control. With this regard, the User waive any right of recourse against IOTA Group.

IOTA Group may not incur liabilities in case of force majeure or unpredictable and insurmountable fact.

Job opportunities/job offers published and posted on the Site do not constitute, in any way, firm offers to enter into an employment contract with IOTA Group but an invitation to contact the Site for the opportunity of employment.

Similarly, an unsolicited application cannot lead to an obligation for IOTA SA or the IOTA Group to offer a job to the User.

 

ARTICLE 9: Hypertext links

External hypertext links may be present on the Site.

IOTA Group may not be held liable for the web pages where these links lead, which are beyond its control. Therefore, the User waive any claim against IOTA Group thereof.

 

ARTICLE 10: Changes of the Terms of Use

The Site reserves the right to modify the present Terms of Use at any time and without prior notice.

 

ARTICLE 11: Duration

The present Terms of Use apply from User’s access to the Site and Services and are applicable without time limitation unless modified or revoked.

 

ARTICLE 12: Applicable Law and Jurisdiction

The present Terms of Use are governed by Swiss law as well as all relations between the User and the Site or IOTA SA. Should a claim occur between the Parties, they will endeavor to reach an amicable settlement. Should they fail to, exclusive jurisdiction is given to the courts of the head office of the IOTA SA.
